Could Malladus Be in Skyward Sword?

Malladus was in new Hyrule. Skyward Sword will take place in the original Hyrule. So no, I don't think Malladus could be in SS.

If that so, why does he only returns much later in the timeline(according to what Nintendo have said: SS-OOT...)?

The battle of Malladus was taken place during New Hyrule's Discovery not way back to SS. I'm positive that Ghirahim will be the highest rank in his tribe because he stated he is the ruler of the surface. He didn't say I'm the second in command who rules the surface. Later cases yes but Ghirahim didn't say it there fore no it won't happen, plus, they already used that boring idea in TP.
